Terms of Service
These Terms govern your use of the FormixxShopify app and related services (the “Service”), operated by Zensbot LLC (“we”, “us”). By installing the app, you (“merchant”, “you”) agree to these Terms.
1. The Service
Formixx automates cash-on-delivery order confirmation for Pakistani Shopify merchants via IVR calls, WhatsApp messages, and reactivation campaigns. We write outcome tags and order notes back to Shopify within 60 seconds of a terminal response.
2. As-is / no warranties
The Service is provided “as is” and “as available”. We don’t warrant it’s uninterrupted, error-free, or that every call will reach every customer (telecom reliability is not something we control end-to-end).
3. Acceptable use
You may not:
- Resell the Service or white-label it as your own.
- Use it to contact anyone who has opted out (see DNC Policy).
- Bypass quiet-hour enforcement (23:00–08:00 PKT) or the per-cycle retry cap.
- Upload customer phone numbers that weren’t collected through a legitimate Shopify checkout.
- Send calls or messages that violate Pakistan Telecommunication Authority (PTA) regulations.
- Attempt to reverse-engineer, probe, or overload our infrastructure.
4. Fair use and plan limits
Paid plans include a monthly call volume as shown on our Pricing page. Overages are billed at the per-call rate disclosed there. We’ll email you if usage patterns suggest abuse (e.g. dialing the same number more than twice a day, or sending to numbers not present in your Shopify customer list) before restricting access.
5. Your responsibilities
- Maintain accurate Shopify credentials and notify us on uninstall.
- Honor customer opt-outs (we surface these via tags and the dashboard).
- Comply with applicable data-protection laws (GDPR if in the EU, PDPA in Singapore, etc.).
- Pay invoices promptly; we’ll suspend the Service for accounts 30 days overdue.
6. Fees & billing
All fees are in PKR (unless Shopify’s RecurringApplicationChargeconverts your account to another currency). Billing runs through Shopify’s Billing API. Refunds are handled per Shopify’s refund policy.
7. Termination
You may uninstall the app at any time from your Shopify admin. On uninstall, we stop making calls within 15 minutes and purge active-session data within 30 days. Orders and call history are retained per our Privacy Policy retention schedule.
We may suspend or terminate accounts that violate Section 3 (Acceptable use) with or without notice. Critical violations (fraud, compliance breaches) result in immediate termination.
8. Liability
To the maximum extent permitted by law, our aggregate liability is capped at the fees you paid us in the 12 months preceding the claim, or PKR 100,000, whichever is higher. We’re not liable for indirect, incidental, or consequential damages (lost profits, lost orders, reputational harm).
9. Intellectual property
Formixx, the Formixx logo, and the software are owned by Zensbot LLC. Your customer data and Shopify content remain yours; we hold a limited license to process it only for the purposes described in the Data Processing Agreement.
10. Governing law and disputes
These Terms are governed by the laws of the Islamic Republic of Pakistan. Disputes will be resolved by binding arbitration seated in Karachi under the Arbitration Act 1940, with English as the language of proceedings.
11. Changes
We’ll post material changes here and, when appropriate, email merchants at least 30 days before they take effect. Continued use constitutes acceptance.
